PRIVACY POLICY

Visits to the websites and institutional portals of the Municipality of Fuencaliente de La Palma are made anonymously. However, they may include specific electronic procedures that require users to log in with digital certificates or to provide personal data essential for the provision of the requested service.

These data will be incorporated into the corresponding processing activities of the Municipality and will be processed for the specific purpose of each processing operation, in accordance with Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (hereinafter LOPDGDD), in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter GDPR), and other applicable regulations on the matter.

For what purpose will we process your personal data?

The main purpose of the processing is to send interested parties general information that may be useful to them and, where electronic procedures are available, the processing and management of administrative files as well as the actions arising from them.

For how long will we keep your data?

We store the data for the time necessary to comply with the legal obligations laid down by administrative regulations, always observing at least the minimum period for keeping the information. In accordance with Article 26 of the LOPDGDD, the processing of the data by this Entity for archiving purposes in the public interest shall be lawful. The regulations on archives and documentation shall apply.

Are there automated decisions?

This Entity may take automated decisions based on the legal coverage granted by Article 41 of Law 40/2015 of 1 October on the Legal Regime of the Public Sector and Article 21 of Royal Decree 203/2021 of 30 March, approving the Regulation on the action and operation of the public sector by electronic means.

This would be any act or action carried out entirely by electronic means within the framework of an administrative procedure, in which no person has intervened directly.

What is the legal basis for the processing of your personal data?

The legal basis for the processing of your data is consent, as a free, specific, informed and unequivocal expression of will accepting the procedure in question (Art. 6.1.a GDPR), although certain processing operations may be legitimised by the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller (Art. 6.1.e GDPR).

To which recipients will your data be disclosed?

This Municipality informs you that the personal data of interested parties will be disclosed to other Public Administrations and to contracted external companies acting as processors, whenever necessary to fulfil the purposes listed above and provided there is legal regulation covering it.

What are your rights over the data provided?

Any person has the right to obtain information on whether or not personal data concerning them are being processed by this Municipality.

Interested parties have the right to access their personal data, as well as to request the rectification of inaccurate personal data concerning them or, where appropriate, to request their erasure when the data are no longer necessary in relation to the purposes for which they were collected, or to withdraw their consent, without prejudice to the fact that this administration may refuse to erase the data, among other reasons, for archiving purposes in the public interest.

Likewise, interested parties have the right, in certain circumstances, to request the restriction of the processing of their data, in which case those data may only be processed, apart from their storage, with the consent of the interested party, or for the establishment, exercise or defence of claims, or with a view to protecting the rights of another natural or legal person, or for reasons of public interest. (You may request the restriction of the processing of the data in the circumstances set out in Article 18 of the GDPR)

The interested party has the right to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them. This Municipality will stop processing the data, except for compelling legitimate grounds or the exercise or defence of possible claims.

Regarding the right to data portability, the interested party has the right to receive the personal data concerning them in order to transmit them to another controller, in a structured, commonly used and machine-readable format, provided that this right is based on consent or on the performance of a contract.

Those affected may exercise their rights by writing to this Municipality, either electronically or in person. This Municipality has made available a request form for the exercise of your rights, which you can access at this Municipality's electronic office.

When and how can I exercise the right to lodge a complaint with the Supervisory Authority?
